Límites éticos del discurso de la laicidad
Abstract
ResumenEl creciente pluralismo religioso y sus exigencias requieren que el Estado adopte unapostura sobre diversos temas polémicos y controvertidos. Otra exigencia contemporáneaes que la ley ofrezca respuestas justas que superen la mera legalidad. En este contexto,el presente artículo pretende acercar los principios éticos que deben involucrarel discurso jurídico sobre la laicidad, dentro y fuera de los procedimientos judiciales.Propone tres principios, dos que deben observarse en los procesos judiciales (verificaciónde las creencias fundamentales y el deber de traducción) y uno referido a laposición del Estado en la esfera pública (prevención contra el argumentum ad hominem).Por último, apunta a un modelo secular inclusivo como la forma ideal para queel Estado se posicione firmemente de cara a los tiempos del pluralismo religioso, porun lado, y del aumento en los procedimientos legales justos, por el otro.AbstractThe growing religious pluralism and its demands require the state’s stance on variouscontentious and controversial issues. Another contemporary requirement is that thelaw has to bring fair responses that overcome the simple legality. In this context, thepresent article aims to bring ethical principles that should involve the legal discourseon secularism, within and out o f court proceedings. It proposes three principles, twoto be observed in lawsuits (verification o f the fundamental beliefs and translationduty) and in a position o f the State in the public sphere (caution against ad hominemargumentum). Finally, it points to an inclusive secular model as the ideal form o f thestate to stand strong in the face o f religious pluralism times, on the one hand, andincreased by fair legal proceedings, on the other.Downloads
